Court orders fine, comp in Justice Palace brawl

Citizen acquitted of theft

KUWAIT CITY, June 27: The Misdemeanor Court acquitted Lawyer Luay Al-Kharafi, Ibrahim Al-Kandari and Athbi Al-Fahad of alleged verbal assault in a case filed over altercations between Sheikhs Dhari, Khalid and Athbi Al-Fahad alongside Sulaiman Kha lif ou h on one side, and Luay Al-Kharafi, Ibrahim Al-Kandari and Ajeel Al-Shaheen on the other.

The court ordered Dhari and Khalid Al-Fahad, Sulaiman Khali fo uh and Ajeel Al-Shaheen to pay fine of KD 150 for physical assault. The court ordered Ajeel Al-Shaheen to pay temporary civil compensation of KD 5,001 in favor of Sheikh Athbi Al-Fahad, and Al-Fahad brothers to pay temporary compensation of KD 5,001 to Luay Al-Kharafi.

It rejected the civil case filed by Al-Fahad brothers against Luay Al-Kharafi and Ibrahim Al-Kandari. It also dismissed a similar case filed by Ajeel Al-Shaheen against Al-Fahad brothers and Khali fo uh due to lack of justification.

It is worthy of note that both parties engaged in physical and verbal attacks inside the Justice Palace. The fight caused injuries to some of the feuding parties and a case was registered in Sharq Police Station.

Citizen acquitted:

The Misdemeanor Court, presided over by Judge Muhammad Al-Mutairi, acquitted a citizen of stealing restaurant and café items as well as betrayal of trust in his capacity as the person in charge of managing the affairs of a café and restaurant.

Details of the case acknowledged by the complainant’s defense team indicate that according to a verbal agreement between him and the accused, the latter will manage the affairs of the café and restaurant for a period of three months during which the suspect will have the authority to instruct the staff, buy materials and receive revenues.

The accused in turn should pay KD4,000 rent for the restaurant, pay the salaries of the staff and keep the rest of the revenues until they sign a legal contract. The accused did not sign the contract but stole a television set, play station and other items worth KD1,600 which belong to the defendant. He also took the restaurant revenues amounting to KD 33,016.800.

Lawyer for the accused, Attorney Ali Al-Ali, asserted in court that the accusations hurled at his client were erroneous and there is no evidence to support them. He argued the investigations were inconclusive as the witnesses of the plaintiff did not prove in court that the accused stole the aforementioned items.

‘Pay investor’s money’:

The Administrative Court, headed by Judge Ahmad Al-Habib, instructed a company to pay KD 40,000 to an investor who leased his truck but the company failed to adhere to the contract.

Lawyer for the investor, Attorney Abdul Aziz Al-Ruk heimi told the court that the company rented his client’s truck on an annual contract renewable as per the terms and conditions agreed by the two parties.

However, the company failed to abide by its side of the contract as it refused to pay the investor and to return the truck in good condition as it was delivered to them. The investor did not receive any payment from the company since the contract was signed, the lawyer narrated.

The court then appointed an expert to evaluate the entire contract and ordered the company to pay KD 40,000 to the investor based on this evaluation.
