Man acquitted of theft
KUWAIT CITY, April 6: The Court of Cassation issued a one-of-a-kind ruling in favor of an individual who was aggrieved by the decision taken by Ministry of Health to refuse sending him for overseas medical treatment. The court ordered the ministry to refer the patient for overseas treatment at the expense of the ministry since the latter is unable to provide the necessary treatment.
Representing the plaintiff was Lawyer Abdulmohsen Al-Qattan, who appealed against the verdict of the Court of Appeals that had overturned the verdict issued by the Court of First Instance Court’s verdict which had granted the Kuwaiti citizen the right to undergo medical treatment in overseas hospitals at the expense of the state.
Lawyer Al-Qattan explained that his client was involved in a traffic accident and was referred to Farwaniya Hospital for treatment of the injuries he sustained especially to his leg. He was later referred to Al-Razi Hospital after the surgery carried out in Farwaniya Hospital resulted in complications. The doctors in Al-Razi Hospital committed malpractice, which prompted his client to sue and demand to be referred overseas for treatment. However, the ministry rejected his application.
Due to the inability of the ministry to provide necessary treatment required for the victim, the court ordered the ministry to refer him for overseas treatment at the ministry’s expense.

Man acquitted: The Criminal Court acquitted an individual who was accused of impersonating police officers and kidnapping and robbing another individual after the latter finished his Asr prayer in Khaitan area.
According to the case file, the victim had just finished Asr prayers and was on his way to his workplace when he was stopped by two individuals on a public road who claimed to be police detectives. They asked for his civil ID but then dragged him into their car and drove off to a distant place where they demanded him to empty his pockets. They stole KD 250 from his wallet and threw the victim and his wallet out of the vehicle before they drove off.
Lawyer Mohammad Al-Khaldi, who represented the suspect, called for invalidation of the arrest procedures due to lack of an arrest warrant from the Public Prosecution, adding that the statements of the arresting officer lacked incriminating evidences against his client.
He said the victim could not have identified the suspect within five minutes when he was in a terrified state during the alleged kidnapping and robbery.
