Case against PM dismissed

KUWAIT CITY, April 20: The Court of Appeals obliged a Kuwaiti citizen to pay for the monthly expenses of his children, monthly house rent of the mother of his children, for furnishing the house, car and the expenses of a domestic helper and driver.

In a case filed by Lawyer Dalal Al-Mutairi on behalf of her client, she sued the citizen, asking the court to provide custody of the children to her client and demand the defendant to pay the abovementioned expenses.

She affirmed the defendant abandoned his children without sustenance even though he is financially capable.

The Court of First Instance had issued the same verdict but Lawyer Al-Mutairi asked for an increase in the expenses based on the current cost of living and increased charges for hiring domestic workers and drivers.

The Court of Appeals ruled in favor of Lawyer Al-Mutairi’s call, obliging the defendant to pay KD 100 monthly rent and KD 600 as monthly expenses including salaries of a domestic worker and driver, as well as make a onetime payment of KD 1,000 for house furniture and KD 3,000 for car.

The Criminal Court sentenced a Kuwaiti citizen, who was accused of attempting to bomb Zayn Al-Abideen Mosque in Salmiya area and of joining a banned organization (DAESH), to sevenyear imprisonment with hard labor. The Public Prosecution had charged the suspect of attempted bombing of Zayn Al-Abideen Mosque in Salmiya area with the use of an explosive belt, attempted murder of worshippers in that mosque, and joining a terrorist group (DAESH) and vowing allegiance to its leader.

Egyptian acquitted:

The Misdemeanor Court has acquitted an Egyptian expatriate who was accused of stabbing an Asian expatriate and robbing him of KD 120 cash and his mobile phone in Khaitan area.

The Public Prosecution had charged the suspect with stealing KD 120 cash and mobile phone violently from the victim. He was also accused of stabbing the victim before fleeing the scene. The victim supported the claim with a medical report. However, the defense counsel Lawyer Esmat Al-Kharboutli countered the allegation, saying there was no concrete proof to indict her client.

She accused the prosecution officer of doing a shoddy job, stressing that the testimonies of the witnesses contradicted the documented statements.

Case dismissed:

The Administrative Court of Appeals presided over by Judge Mohammad Khattab overturned the verdict issued by the Court of First Instance which blamed His Highness the Prime Minister Sheikh Jaber Al-Mubarak Al-Sabah for failing to apply seven laws, and obligated him to pay compensation worth KD 5,001 to Lawyer Khalid Al-Zamel. The court instead rejected the lawsuit.

The defense counsel of the government, Lawyer Jamal Al-Jalawi stressed that the lawsuit lacked local standing and sufficient evidences to prove that the Prime Minister did not carry out his responsibilities. He requested the court to dismiss the lawsuit and obligate the plaintiff to pay the fees.

It is expected that Lawyer AlZamel will appeal the verdict with the Court of Cassation, asking for proving the responsibility of the Prime Minister.
