KUWAIT CITY, July 29: The Court of Cassation revoked the verdict issued by the Court of Appeals which sentenced a Kuwaiti citizen to 15year imprisonment with hard labor. The court instead acquitted him of the charges of drug possession and peddling.
The Public Prosecution had charged the defendant of possessing and peddling drugs such as hashish and opium.
According to the case file, when officers from the Drugs Control General Department received information about a Central Prison inmate who collaborated with the citizen and two other individuals to hide some drugs and intoxicants he owns, they launched investigations and confirmed the information.
After obtaining a warrant from the Public Prosecution, they raided his house and the cars of his accomplices.
During the court session, Lawyer Ahmed Ja’afar said the decision of the Court of Appeals contradicts the correct enforcement of the law and the trading intention.
He stressed that his client’s arrest violated the Public Prosecution’s warrant, highlighting the lack of evidences other than the officer’s testimony.
Grandma gets custody:
A Family Court in Farwaniya dismissed a lawsuit filed by a Kuwaiti woman against her husband and his mother, insisting that custody of their kids should be given to her. The court instead gave the custody to the husband’s mother .According to the case file, the woman married her husband legally and they were blessed with children.
However, she later accused the husband of abandoning her and not catering for her and the children’s expenses. Representing the grandmother (husband’s mother) was Lawyer Abdulmohsen Al-Qattan who affirmed that the complainant does not deserve custody as she did not deny that she cheated on her husband more than once.
He stressed the grandmother’s keenness to ensure the children are brought up, adding that she meets all the conditions to be granted their custody.
Verdict revoked:
The Court of Appeals revoked the verdict issued by the Criminal Court in absentia against four Kuwaiti brothers, sentencing them to ten-year imprisonment with hard labor for allegedly kidnapping, beating and restraining the freedom of their sister as well as attacking an officer while he was on duty.
The defense counsel Lawyer Abdullah Al-Diyab rejected the verdict that convicted the brothers, insisting that there are no incriminating evidences to prove that the brothers forcefully kidnapped their sister and attacked an officer. He called for invalidation of the investigations conducted.
