KUWAIT CITY, June 10: The Civil Court of Appeal has nullified the ruling of First Instance Court that ordered a Lebanese merchant to pay KD 173,000 based on an official undertaking he signed to coestablish a company. The court thereby dismissed request by the respondent to make the merchant pay the sum.

The case file indicated the merchant sealed an agreement with the respondent to co-establish a company and contribute KD 173,000 to the funding. The merchant studied all necessary documents related to the issuance of license for the company before signing the Ministry of Justice official document to affirm the debt. However, the respondent did not carry out the necessary obligation and rather filed a case demanding the sum.

Representing the merchant, Lawyer Jassem Al-Tuwaitan prayed the court to strike out the case and nullify the undertaking signed for a single tranche refund. He hinged his argument on fraud and deception, imploring the court to regard the agreement and its ensuing effects as nonexistent. He requested the court to make the respondent pay the legal fees.

Verdict upheld:

The Civil Circuit of the Court of Appeals upheld the verdict issued by the Court of First Instance which dismissed a lawsuit filed by the government represented by the Fatwa and Legislation Department against Kuwait Football Association (KFA) and the dissolved Kuwait Olympic Committee (KOC).

The government had filed a lawsuit against Chairman of KFA and KOC Sheikh Talal Al-Fahad along with the members in their capacity, demanding payment of KD 5,001 as temporary compensation based on allegations that they caused the international ban on Kuwaiti sports activities.

The government claimed in its lawsuit that the accused committed two errors which led to the ban on Kuwaiti sports - submitting an international complaint against Kuwait, and deliberately delaying the grievance of the ban decision at FIFA and the International Olympic Committee.

It is worth mentioning that former minister of Youths and Sports Sheikh Salman Al-Hamoud had declared to initiate a lawsuit in preparation for demanding final compensation worth KD 400 million against the accused for causing the ban on Kuwaiti sports activities as well as tarnishing the reputation of Kuwait in international events.
