Comp for citizen ordered in mistaken arrrest

KUWAIT CITY, Feb 9: The Administra­tion Court ordered Ministry of Interior to pay temporary civil compensati­on worth KD 5,001 to a Kuwaiti citizen who sustained ethical, moral and financial damages after he was mistakenly arrested.

Representi­ng the citizen was Lawyer Nasser Al-Sarheed who explained that his client was arrested at Salmi border checkpoint while leaving the country with his family. He was referred to Jleeb Al-Shuyoukh Police Station, and then to Shuwaikh Industrial Area Police Station.

His client underwent terrible ordeal with the police due to an alleged travel ban imposed on him because of several criminal and financial cases filed against him. He was released after he vowed to present himself at the authority when summoned.

The client attempted to exit again via the same border checkpoint and he was arrested again. He spent 22 days in prison.

However, his fingerprin­t report indicated that he was a victim of identity theft, and the authoritie­s realized that a Palestinia­n man had stolen his identity due to similarity in their names.

Attorney Abdul-Aziz Al-Enezi won a case to mandate a bank to refund KD19,273 – deductions from the indemnity of a female employee as insurance subscripti­on.

Al-Enezi explained that law number 17/2018 obligates companies to refund insurance subscripti­on deducted from the indemnity of Kuwaitis and Gulf nationals, so the law should be applied without delay. He said the concerned employees have the right to submit petitions in this regard before the end of April if the law is not applied for the judiciary to look into their petitions.

He clarified various cases – resignatio­n, retrenchme­nt or transfer before or after the law was issued – have different legal interpreta­tions.
