The figure KD1850+KD250 = KD2,100 will be used to calculate his indemnity because the law says that the last ‘remunerati­on’ must be used for this purpose. And according to the law ‘remunerati­on’ means the basic salary plus all the allowances received on a regular basis.

In addition he will get half the indemnity because his service is over 3 years but less than five years in addition to the fact that he has resigned. The indemnity will therefore be calculated as follows: Service: 4.8 yrs Salary: KD2,100 He’s entitled to 15 days pay for each year of service = 4.8x15 = 72.0 days.

But these days must first be divided by 26 (working days in a month) = 72/26 = 2.7692 months salary = 2.7692 x KD2,100 = KD 5,815.000

He will get the above amount of indemnity if he has been fired but if he has resigned he will get half (KD5,815/2 = KD2,907.66) of that.

Anyone resigning before 3 years is entitled to nothing and we are not aware of any changes to that effect.

Yes, you can reduce the number of days notice period not served from his settlement and if you have previously not decided to forego those number of days.

I came to Kuwait one year ago with supervisor designatio­n on Visa 18. I have engineer degree. I would like to know if my designatio­n could change from supervisor to engineer (holding KSE NOC) in the same company. As my company told me that, they have rejected my papers. So can you please tell me if there is any such rule for transferri­ng my visa? Your advise and comment will be highly appreciate­d. Please.

All designatio­n changes must be okayed by Public Authority for Manpower so if your company is telling you that the change was rejected we have no reason to doubt what you were told. The only advise we can give is that you maintain your current designatio­n if you want the transfer to be effected.
