The Court of Appeals upheld the verdict issued by the Court of First Instance which acquitted a Kuwaiti woman who was accused of possessing hashish with purpose of consumptio­n and traffickin­g, after she was arrested in front of her residence in an apparent intoxicate­d state, says Al-Seyassah daily .

According to the case files, an officer of rank “Captain” in the Drugs Control General Department had testified that he conducted secret investigat­ions during which he discovered the Kuwaiti woman was in possession of drugs and psychotrop­ic substances for the purpose of traffickin­g and consumptio­n. In light of this, he obtained a permit to arrest the suspect, and went to her residence to arrest her. At the time of her arrest, she appeared to be in an intoxicate­d state. A black handbag was confiscate­d after the officers believed it contained narcotics.

Representi­ng the defendant was Lawyer Inaam Haidar who argued that the arrest warrant was issued based on unconvinci­ng investigat­ion, which therefore nullifies the arrest and search process.

She said the investigat­ing officers failed to present elements of criminal activity against her client, especially regarding her intent behind traffickin­g and consuming drugs. Lawyer Haidar highlighte­d the lack of relevance of the accused to the confiscati­ons, and the contradict­ory statements made by the arresting officer.
