The Court of Appeals upheld the verdict issued by the Court of First Instance which acquitted a Kuwaiti woman who was accused of possessing hashish with purpose of consumption and trafficking, after she was arrested in front of her residence in an apparent intoxicated state, says Al-Seyassah daily .
According to the case files, an officer of rank “Captain” in the Drugs Control General Department had testified that he conducted secret investigations during which he discovered the Kuwaiti woman was in possession of drugs and psychotropic substances for the purpose of trafficking and consumption. In light of this, he obtained a permit to arrest the suspect, and went to her residence to arrest her. At the time of her arrest, she appeared to be in an intoxicated state. A black handbag was confiscated after the officers believed it contained narcotics.
Representing the defendant was Lawyer Inaam Haidar who argued that the arrest warrant was issued based on unconvincing investigation, which therefore nullifies the arrest and search process.
She said the investigating officers failed to present elements of criminal activity against her client, especially regarding her intent behind trafficking and consuming drugs. Lawyer Haidar highlighted the lack of relevance of the accused to the confiscations, and the contradictory statements made by the arresting officer.
