Man sues school and teacher over as­sault on son

KUALA LUMPUR: An an­gry fa­ther, whose school-go­ing son en­dured phys­i­cal abuse at the hands of an­other stu­dent on nu­mer­ous oc­ca­sions, has filed a civil suit against his son’s school and teacher.

The man on Tues­day filed a neg­li­gence suit against the school, which he said had not taken ad­e­quate ac­tion against the as­saults and the re­place­ment teacher, who was present in class when his son was kicked in the but­tocks and bit­ten on the cheek by the class “bully”.

While the son is the first plain­tiff in the suit, the man has been named the sec­ond plain­tiff, with the school and teacher be­ing the first and sec­ond de­fen­dants.

In the suit, which was filed at the High Court Reg­istry in Jalan Duta, both fa­ther and son are seek­ing RM6,000 in spe­cific dam­ages, gen­eral dam­ages and other costs.

Yes­ter­day at the Duta Court Com­plex, the man said his son was as­saulted three to four times, from Septem­ber last year in school by his class­mate, who is a for­eigner, with a “more se­ri­ous” as­sault hap­pen­ing on June 1, this year which had re­sulted in his son hav­ing his but­tocks kicked and cheek bit­ten.

“This hap­pened in his class, just one or two me­tres away from where the teacher was stand­ing and she did not do any­thing to stop the as­sault. The school and the teacher failed to keep my son safe.

“Though my son is big­ger in size than his class­mate, he never re­tal­i­ated to any of the as­saults. Ini­tially, we as par­ents thought all (of this) was nor­mal, but when the bul­ly­ing be­came re­peated and se­ri­ous, we had to take ac­tion.”

The man also said that af­ter the June 1 as­sault, his son had been trau­ma­tised and had to be taken out of school.

Cur­rently, he is be­ing home­schooled.

Also present at the press con­fer­ence was the son, who stood close to his fa­ther, hold­ing his hands from time to time.
