Man sues school and teacher over assault on son

KUALA LUMPUR: An angry father, whose school-going son endured physical abuse at the hands of another student on numerous occasions, has filed a civil suit against his son’s school and teacher.

The man on Tuesday filed a negligence suit against the school, which he said had not taken adequate action against the assaults and the replacemen­t teacher, who was present in class when his son was kicked in the buttocks and bitten on the cheek by the class “bully”.

While the son is the first plaintiff in the suit, the man has been named the second plaintiff, with the school and teacher being the first and second defendants.

In the suit, which was filed at the High Court Registry in Jalan Duta, both father and son are seeking RM6,000 in specific damages, general damages and other costs.

Yesterday at the Duta Court Complex, the man said his son was assaulted three to four times, from September last year in school by his classmate, who is a foreigner, with a “more serious” assault happening on June 1, this year which had resulted in his son having his buttocks kicked and cheek bitten.

“This happened in his class, just one or two metres away from where the teacher was standing and she did not do anything to stop the assault. The school and the teacher failed to keep my son safe.

“Though my son is bigger in size than his classmate, he never retaliated to any of the assaults. Initially, we as parents thought all (of this) was normal, but when the bullying became repeated and serious, we had to take action.”

The man also said that after the June 1 assault, his son had been traumatise­d and had to be taken out of school.

Currently, he is being homeschool­ed.

Also present at the press conference was the son, who stood close to his father, holding his hands from time to time.
