Ex-Linear director acquitted of making false statement

KUALA LUMPUR: The Sessions Court, here, yesterday ordered the release of a former company director who was charged with making a false statement to Bursa Malaysia Securities Bhd without c a l l i n g f o r h i s d efence.

Judge Samsudin Abdullah acquitted a n d d i s c h a rg e d J. Alan Rajendram, 61, of the charge after finding that the prosecutio­n had failed to establish a prima facie case against him.

He also ordered the bail of RM150,000 to be returned to the accused.

Alan Rajendram was charged with submitting a false statement on the affairs of listed corporatio­n Linear Corp Bhd, as contained in the company’s announceme­nt dated December 29 2009.

The offence was allegedly committed at Bursa Malaysia Securities, Exchange Square Bukit Kewangan on December 29 2009.

The offence, under Section 369(b)(B) of the Capital Markets a n d S e r v i c e s Ac t 2009, provides an imprisonme­nt of up to 10 years and a fine of up to RM3 million, if found guilty.

A total of 13 prosecutio­n witnesses were called to testify during the hearing, which started on October 20 last year.

Deputy public prosecutor Mohd Hafiz Mohd Yusoff appeared for the prosecutio­n, while the accused was represente­d by counsel Datuk N. Sivanantha­n. Bernama
