Prosecutio­n fails to tender medical report of student allegedly hit by him

THE Jawi magistrate’s court here yesterday fixed Feb 19 as the final mention date for the case of a teacher who was charged with hitting his student last August.

Magistrate Hizween Azleena Othman Kamal set the date after the prosecutio­n failed to tender the medical report that was supposed to be handed to the court.

Lawyer Mohd Fadhly Yaakob asked for a discharge not amounting to an acquittal after the prosecutio­n failed to tender the report on the third mention date.

“Until now the prosecutio­n had failed to tender the medical report.

“This means that the charge is premature.

“As such, we ask for Cikgu Idzahril (Noor Idzahril Ahmad) to be discharged not amounting to an acquittal,” he said when met at the court compound here.

Idzahril, 53, an English language teacher at SK Sungai Acheh, was charged with hitting a Year Three pupil of SK Sri Sentosa on Aug 2.

He was charged under Section 323 of the Penal Code which carries a maximum jail of one year or a maximum fine of RM2,000 and/or both upon conviction.

Deputy public prosecutor Muhammad Uzair Abd Munir prosecuted.

More than 100 supporters of Idzahril, including several nongovernm­ental organisati­ons (NGOs), gathered outside the court to lend their support to him.

Present was Congress of Unions of Employees in the Public and Civil Services president Datuk Azih Muda.

Idzahril’s case had attracted widespread attention in recent weeks.

Gabungan Pelajar Melayu Semenanjun­g (GPMS) launched the #pray4cikgu­idzahril campaign for him.
