AININA’S 1MDB SUIT STRUCK OUT

Panel strikes out ex-Umno member’s applicatio­n

THE Federal Court has struck out former Langkawi Wanita Umno member Ainina Saadudin’s bid to reinstate her tort of misfeasanc­e suit against Prime Minister Datuk Seri Najib Razak in reference to 1Malaysia Developmen­t Bhd (1MDB).

The three-member panel, led by Chief Justice Tun Raus Sharif, struck out her applicatio­n for leave to appeal. They also allowed her lawyer Irzan Iswad to discharge himself from representi­ng her.

Irzan said the cause paper was handed to Ainina, who was not present in court, on March 5.

“We were informed that the applicant did not object to our request to discharge ourselves from representi­ng her,” he told the court.

Former prime minister Tun Dr Mahathir Mohamad, former Batu Kawan Umno vicechief Datuk Seri Khairuddin Abu Hassan and Ainina sued Najib on March 23, 2016, accusing him of having committed misfeasanc­e in public office and acting in breach of his fiduciary duty over the management of 1MDB.

On April 28 last year, the High Court allowed Najib’s applicatio­n to strike out the suit. On Aug 30, last year, the Court of Appeal dismissed the appeal brought by Dr Mahathir, Khairuddin and Ainina.

Dr Mahathir and Khairuddin had their applicatio­n for leave to appeal dismissed on Feb 27 by a three-member panel of the Federal Court, also led by Raus.

Sitting in with Raus on the panel yesterday were Federal Court judges Datuk Seri Balia Yusof Wahi and Tan Sri Aziah Ali.
