Musa seeks to declare sitting unlawful

KOTA KINABALU: Tan Sri Musa Aman will take legal action to declare the special Sabah Legislativ­e Assembly sitting unlawful.

In a statement, his solicitors from Messrs F.T. Ahmad and Co said the dispute would be added to the original summons filed by Musa in his action claiming that Datuk Seri Mohd Shafie Apdal was unlawfully sworn in as chief minister on May 12, and to declare the appointmen­t null and void.

“Notwithsta­nding the additional issue of the unlawful convening of the special sitting of the state legislativ­e assembly on June 11 (yesterday), Tan Sri Musa Aman will proceed with his court action to declare inter alia, that he is the lawful chief minister of Sabah and not Datuk Seri Mohd Shafie Apdal, and other reliefs, including a declaratio­n that all acts and things done by Shafie after his purported swearing in on May 12 as null and void,” it read.

The statement said one of the company’s lawyers, Tengku Ahmad Tengku Fuad, said Musa had instructed his lawyers to look into and consider amending the originatin­g summons, to include the issue of the unlawful special sitting.

The statement quoted Tengku Ahmad as saying: “My client views with concern that the special sitting is an attempt to thwart his court action and to pervert the course of justice as it is public knowledge that the court action has yet to be decided.

“It is illogical for the special sitting to be convened given the conflict between the two appointed chief ministers.

“Who will the speaker be putting to sit on the government bench?”

The statement said it would be illogical for Speaker Datuk Syed Abas Syed Ali to put Shafie on the government bench.

That would be tantamount to Syed Abas taking sides and making a decision that ought to be reserved for the court of law given the action taken by Musa, it added.
