Duo on death row for murder lose appeal

KOTA KINABALU: The Court of Appeal here yesterday dismissed an appeal by a labourer against his conviction for killing a man, six years ago.

Justices Datuk Lim Yee Lan, Dato' Abdul Rahman Sebli and Puan Sri Dato' Zalehah Yusof unanimousl­y upheld the death sentence of Norol Rojik Jun, 36, who had appealed to have his sentence and conviction set aside.

On February 5, 2016, the lower court had sentenced the appellant to death by hanging after finding him guilty of murdering a man, aged 40 years old, at the second floor of a building at Singgahmat­a Road in Lahad Datu on November 12, 2011.

The offence under Section 302 of the Penal Code carries the mandatory death sentence, upon conviction.

Deputy public prosecutor Ahmad Sazilee Abd Khairi appeared for the respondent.

Meanwhile, the Court of Appeal yesterday also affirmed the 20 years' jail sentence of a man for causing the death of his wife.

In setting aside the appeal and upholding the sentence, Justices Datuk Lim Yee Lan, Dato' Abdul Rahman Sebli and Puan Sri Dato' Zalehah Yusof, held that there were no reasonable grounds for the appeal by convicted Mohd Azmil Abbas, 38, to be allowed.

The lower court had sentenced the appellant to 20 years' jail after finding him guilty of committing culpable homicide not amounting to murder of his spouse, aged 26, at a house at Kampung Somboi in Kinarut, Papar on September 1, 2013

He was convicted under Section 304 (a) of the Penal Code, which is punishable with imprisonme­nt of 30 years and a fine, upon conviction.
