Mischief act lands man in jail

KOTA KINABALU: For committing mischief, a man was sentenced to three months’ jail by the Magistrate’s Court here yesterday.

Magistrate Jessica Ombou Kakayun passed the sentence on Mohd Gunawan Abdul Kadil, 26, after he pleaded guilty as charged under Section 426/34 of the Penal Code.

The indictment provides for a jail term of up to five years or a fine or both, upon conviction.

Mohd Gunawan committed the offence together with three other persons, who were already convicted, by cutting the cable wires of an eatery at Anjung Perdana Tanjung Aru 1 here at 6 am on May 29.

Prosecutin­g officer Inspector Rasydan Jasni told the court that the accused was caught by police in the area.

The police saw the accused together with three others cutting the cable wires and putting them in a car. Tools that were used to cut the wires were also found.

In mitigation, the accused, who was represente­d by a lawyer, pleaded for a lenient sentence on the grounds that he was influenced by his friends to commit the offence.

The court also ordered the accused to serve his jail sentence from the day of his arrest.
