Man claims trial to robbing shop employee

KOTA KINABALU: A local claimed trial at the Sessions Court here yesterday to robbing a man of RM180 with a machete at a convenienc­e shop in Papar.

Mohd Nazib Wata, who appeared before judge Noor Hafizah Mohd Salim, was charged under Section 392 of the Penal Code and punishable under Section 397 of the same Code.

He faces a jail term of up to 14 years and also liable to a fine and whipping, upon conviction.

The accused allegedly committed the offence against Saeed Zar Jamil at Ishra Enterprise shop at Kampung Anak, Papar at 7.45pm on July 21.

In pleading for bail, the accused, who was not represente­d, told the court that his wife was currently pregnant so there would be no one to take care of her after giving birth.

He also said that he wanted to get a lawyer to represent him.

Meanwhile, deputy public prosecutor Husna Abdul Halim contended that the accused had a similar conviction and was released from prison on November, 2016.

Therefore, she objected to any bail to be given to the accused as the offence was serious and involved the use of a dangerous weapon.

The judge fixed August 16 this year for pre-trial case management and ordered the accused to be further detained in custody, pending disposal of the case.
