KOTA KINABALU: A premises caretaker was fined RM25,000, in default, 24 months’ jail for possessing 12 pornographic digital video discs (DVDs)

Magistrate Jessica Ombou Kakayun imposed the fine on Filipino Kazmer Mohd Ali, 21, after he pleaded guilty under Section 5 (2) of the Film Censorship Act 2002.

The charge carries a maximum fine of RM50,000 or a jail term of up to five years, or both, upon conviction.

Kazmer was arrested at Centre Point Shopping Complex Movie Station, Unit No. G48, Corner B, on August 2 after the police found the DVDs inside one of the drawers there.

The court also ordered the accused to be referred to the Immigration Department for further action.

Another Magistrate’s Court sentenced an unemployed to six months’ jail for trespassing into a worker’s quarters.

Magistrate Cindy Mc Juce Balitus meted out the sentence on Renny Nujiri, 27, after he admitted to a charge under Section 447 of the Penal Code.

The unrepresented accused was caught breaking into the place along Jalan Numbak in Manggatal on August 3.

Prosecuting officer Inspector Albert Basirin told the court that before the incident, the complainant and one of his workmates saw the accused taking off a zinc sheet at the house area.

The complainant asked the accused why he did that and was told that he was asked by his friend to come there.

However, when the complainant asked again who was his friend, the accused could not answer, prompting the complainant to detain the accused.

They then called the police who later came to arrest the accused.
