Retailers fined for keeping unregistered health products
KOTA KINABALU: The Sessions Court here yesterday fined a retailer RM10,000 for possessing unregistered health products.
Judge Azreena Aziz meted out the sentence on E-Noveal Trading Sdn Bhd after its representative pleaded guilty to the charge under Regulation 7(1)(a) of Control of Drugs and Cosmetics Regulations 1984.
The indictment provides for a maximum fine of RM25,000 or up to three years’ jail upon conviction.
The company had possessed two types of unregistered products, which were foot patches, at its premises at Karamunsing here at 11am on March 24.
Based on the facts of the case, three types of products were seized during a raid at the premises by the Pharmacy Department enforcement division.
The seized products were checked and two of the products were found not registered with the Ministry of Health.
In mitigation, the representative prayed for a lenient sentence while prosecuting officer from the Pharmacy Department requested for a deterrent sentence to be imposed on the accused.
The court allowed the fine to be paid in three instalments.
The first instalment of RM3,000 was made yesterday while another two instalments of RM3,500 each would be paid by September 29 and October 28 this year, respectively.
Meanwhile, another retailer was fined RM6,000 by the same court for committing a similar offence.
A representative from Borneo Islamic Media Sdn Bhd, who appeared before the judge, admitted to the charge under Regulation 7(1)(a) of the Control of Drugs and Cosmetics Regulations 1984.
Nine massage oils, which were unregistered with the Ministry of Health, were found in its possession at The House of Islamic at Wisma Yakin here at 11am on January 11.
The court allowed the fine to paid in two instalments of RM3,000 each with the first payment yesterday while the second payment would be on September 29.
