Man jailed for possessing stolen motorcycle

KOTA KINABALU: A 53-yearold man was jailed 12 months by the Magistrate’s Court here yesterday for possessing a stolen motorcycle.

Magistrate Cindy Mc Juce Balitus imposed the sentence on Pungsin Anik after he pleaded guilty to a charge under Section 411 of the Penal Code.

The accused was arrested for keeping the stolen item belonging to a man aged 21 at Jalan Lama Papar - Kota Kinabalu on August 12.

The facts of the case stated that the complainan­t had lodged a report stating that his motorcycle which was locked and parked properly went missing.

A traffic police subsequent­ly lodged a report saying that during an operation, he had stopped the accused and conducted a check on his motorcycle which did not have registrati­on numbers at the front and back of the motorcycle.

Based on a further check using MCops, it was found that the motorcycle was the one that had been reported missing.

In an unrelated case, Hendru Agustinus, 35, was sentenced to five years’ jail and ordered to be whipped once by the same court for consuming syabu.

The court found the accused guilty of the charge under Section 15(1)(a) of the Dangerous Drugs Act 1952 which is punishable under Section 39C of the same Act as the accused had more than two conviction­s.

The accused was arrested on April 19 at Karamunsin­g police station after his urine sample tested positive for drug abuse.

The court also ordered the accused to be placed under police supervisio­n for two years.

The prosecutio­n had called three witnesses to testify against the accused, who was the sole defence witness.
