Man jailed two years for joining riot, threatening another man
KOTA KINABALU: The Magistrate’s Court here jailed a man a total of two years for two counts of participating in a riot and threatening another man.
Magistrate Jessica Ombou Kakayun imposed the sentence on Alih Ismail, 24, after he pleaded guilty to both the charges, yesterday.
On the first charge, the undefended accused was sentenced to 12 months behind bars for joining a riot and armed with a machete at a restaurant at Plaza 333 in Penampang on April 15.
The offence, under Section 148 of the Penal Code , carries a maximum jail term of five years or a fine or both, upon conviction.
On the second charge, the accused received another 12 months’ jail for threatening the man at the same time and place.
He was convicted under Section 506 of the same Code which is punishable by a jail term of up to seven years or a fine or both, upon conviction.
The court ordered for both the jail terms to run concurrently.
The accused is now serving jail for injuring another man and the court ordered both the jail terms to run consecutively with his previous sentence as it involved different victims and locations.
Apart from that the accused was also ordered to be referred to the Immigration Department after serving all the jail terms for further action.
