KOTA KINABALU: A man was jailed for seven months by the Sessions Court here yesterday for overstaying in the state.

Judge Azreena Aziz imposed the sentence on Husein Taslim, 33, after he admitted to a charge under Section 15 (1)(a) of the Immigration Act 1959/63.

The indictment carries a maximum fine of RM10,000 or a jail term of up to five years, or both, upon conviction.

He was caught around Penampang for staying in the State after his passport expired on May 16, 2014.

In mitigation, Husein, who was unrepresented, prayed for leniency as he has seven little children, who need his care, and he is the sole breadwinner.

Meanwhile, the same court jailed four persons, including two women, for four months while another three women were fined RM4,000, in default, four months’ jail each for entering the state illegally.

All of the accused, aged between 19 and 35, pleaded guilty before the judge to each of their charges under Section 6 (1)(c) of the Immigration Act 1959/63.

The indictment provides for a maximum fine of RM10,000 or a jail term of up to five years, or both and whipping of not more than six strokes of the cane, upon conviction.

The judge also ordered all the accused, including Husein, to be referred to the Immigration Department after serving their sentences.
