KOTA KINABALU: A local man was sentenced to 12 years’ jail and two strokes of the cane for robbing a man who had given him sexual services.

Sessions Court judge Noor Hafizah Mohd Salim meted the sentence on the accused, Mohd Redha Sarigan, 30, after he pleaded guilty to a charge under Section 392/397 of the Penal Code, which carries a jail term of up to 20 years jail and whipping, upon conviction.

Mohd Redha was found guilty of robbing the man of his perfume, a pack of cigarettes, RM90 cash and two keys at a house in Cyber City Phase 2, Penampang at 1 am on November 6.

In mitigation, the accused pleaded for leniency on the grounds that he is a first time offender and promised not to commit the offence again. He also said that he has an aged father, who is dependent on him.

Deputy public prosecutor, Dinesh Raja, pressed the court to impose a deterrent sentence on the accused in view of the nature and seriousness of the offence.

The facts of the case stated the victim was contacted by the accused, using the name ‘Tajul’ through the social media app ‘WeChat’, whereby the accused had asked the victim for sex service, which the victim agreed to for RM150.

They subsequently met at the victim’s house where the victim provided sexual service to the accused, including oral sex.

When the victim asked for payment before performing another round of oral sex, the accused promised to pay after the next oral sex service is performed which the victim agreed to.

The accused then asked the victim to lie prone on the bed after which he proceeded to tie the victim’s hands at the back with a cable.

Armed with a knife, the accused then demanded some money from the victim, who said he had no money with him.

The accused then gagged the victim’s mouth with a shirt and began ransacking the victim’s wardrobe where he found a wallet and took the money inside it.

He then brought the victim, whose hands and feet were tied up, to the living room and took some items there before locking the victim into a room and leaving the house.

The victim, who managed to free himself, contacted his sister who then called MERS 999 to report the incident. Mohd Redha was subsequently arrested by the police on November 9.

Meanwhile, in the Magistrate’s Court, the same accused, Mohd Redha was also sentenced to five years for possessing a dangerous weapon in public.

He pleaded guilty before magistrate Stephanie Sherron Abbie to possessing a ‘kerambit’ (knife) in the right pocket of his pants at Nasi Ayam Juara Restaurant in Penampang at 8.45 pm on November 9.

Mohd Redha was charged under Section 6(1) of the Corrosive, Explosive and Dangerous Weapon Act 1958 (Amended 1988) which provides for a jail term of up to 10 years and whipping, upon conviction.
