Two jailed, one claims trial over stolen properties

KOTA KINABALU: At the Magistrate­s Court here yesterday, two men were sentenced to jail while another man claimed trial for retaining stolen properties.

Senior assistant registrar, Herlina Muse, presiding as magistrate, meted out jail sentences on Mohd Shameer Marican Ariffin, 24, and Tommy Joibi, 30, after both accused pleaded guilty as charged under Section 411 of the Penal Code, the punishment of which is a jail term of up to five years or a fine or both, upon conviction.

Mohd Shameer was alleged to have retained an audio system belonging to a furniture shop at an unnumbered house at Kampung Peringatan in Petagas on October 17.

According to the facts of the case, the unrepresen­ted accused was apprehende­d by the police after a police report was lodged and the accused led police to where the item was kept in his bedroom.

Meanwhile, Tommy admitted retaining some stolen items, namely, a Malaysian identity card bearing number 880813-12-5600, various cards, a bank account book and a gadget belonging to a woman when he was apprehende­d by the police at Kampung Pulutan in Menggatal on August 29.

Prosecutin­g officer, Inspector Albert Basiri, told the court that a police report was lodged by the complainan­t stating that her bag and that of her friend which contained all the items were missing. Not along afterwards, police managed to arrest the accused, who then admitted to retaining the stolen items.

The magistrate also ordered for both accused to serve their jail terms from the date of their arrest and for all the exhibits to be returned to its rightful owners.

Meanwhile, another accused, Cladius Fred, 37, claimed trial in the same court to a similar charge of retaining stolen properties.

The accused was alleged to have kept a television and a microphone at an unnumbered house at Kampung Ganang in Kepayan on October 17.

In view of his plea, the court fixed December 11 this year for case management and released the accused on bail of RM5,000 in two local sureties, pending disposal of the case.
