A 32-year-old man was sentenced to 20 years’ jail and 14 strokes of the cane by the Sessions Court yesterday for raping his 14-year-old daughter since she was nine and impregna ng.
TAWAU: A 32-year-old man was sentenced to 20 years’ jail and 14 strokes of the cane by the Sessions Court here yesterday for raping his 14-year-old daughter.
Sessions Court Judge Awang Kerisnada Awang Mahmud meted out the sentence on the accused to a charge under Section 376B(1) of the Penal Code which provides for an imprisonment of not less than 10 years and not more than thirty years and whipping of not less than ten strokes.
The accused who holds a permanent resident status was charged with raping the victim on October 29, at about 10pm at an unnumbered house at Kampung Kurnia Jaya, Mile 4 Apas Road.
Investigation found that the victim was raped since she was nine years old whenever her mother and siblings were not at home. The accused threatened to kill the victim if she did not comply.
On November 7 at about 4pm, the victim was taken ill but when her mother brought her to a private clinic, she was shocked to learn that the girl was 22 weeks pregnant.
The victim then revealed to her mother what had happened.
A police report was lodged on the same day and the accused was arrested on November 8, at about 3pm at a ‘bagang’(anchovy fishing platform) at Silingan Island, Semporna.
Deputy Public Prosecutor Mohammad Wan Fitri Wan Azizan prosecuted the case.
At the same court, a 21-yearold local man was sentenced to 12 years’ jail and five strokes of the cane for statutory rape of a 15-year-old girl.
Judge Awang Kerisnada meted out the sentence on Muhamad Husin bin Albat to a charge under Section 376(1) of the Penal Code.
The accused raped the victim in a Toyota Vigo on March 29, at about midnight at Kampung Bugaya, Semporna.
The victim made a police report on the same day and the accused was detained on April 4 at about 2.45am at Seri Balung Flat, Tawau.
Deputy Public Prosecutor Mohammad Wan Fitri Wan Azizan prosecuted the case.
