20 years, 10 lashes for raping, impregnati­ng 13-year-old girl

KOTA KINABALU: A 52-yearold man, with a record of previous rape conviction in 2002, was sentenced to 20 years jail and 10 lashes of the cane after he admitted to committing a similar offence on a teenager, who had given birth to his child.

Sessions Court judge Azreena Aziz meted the sentence on Jikau Gani after he pleaded guilty as charged under Section 376 (2) of the Penal Code which provides for a maximum jail term of 30 years and whipping, upon conviction.

The accused admitted to raping the 13-year-and four-month-old girl in a room of a house at a village in Kuala Penyu in May, 2016.

The facts of the case stated that the accused had raped the victim despite her shouts for help which no one heard. The victim’s eldest sister informed their father of her suspicion that the victim was pregnant and when he brought his daughter for a check-up, it was confirmed that she was pregnant after being raped by the accused.

The victim gave birth to the accused’s child on January 24. The accused had previously been sentenced to 10 years’ jail for a similar offence in 2002.

The court also ordered him to pay RM10,000 in compensati­on, in default, six months’ jail plus two years police supervisio­n.

Meanwhile, Yamin Kamansis, 61, claimed trial at another Sessions Court here after being charged with outraging the modesty of a teenager by touching her breasts.

The accused who was brought before judge Noor Hafizah Mohd Salim, was alleged to have touched the breasts of the teenager in a bedroom of a house in a village at Kinarut at 11.30 pm on November 9.

In view of his plea, the court set May 16-19 next year for the trial and denied bail to the accused.

In a separate case, Herman Sah Adris, 39, and Herwandy Adris, 41, were ordered to stand trial on April 26 next year in the same court for allegedly causing grievous hurt to a 35-year-old man in front of a shop in Putatan at 8pm on July 29.

The siblings were charged under Section 326, read together with Section 34 of the Penal Code which carries a jail term of up to 20 years and a fine, upon conviction.
