Man ordered to defend oral sex charge

KOTA KINABALU: A man, charged with inciting a 14-yearold teenager to perform an act of gross indecency, was ordered by the Sessions Court here yesterday to enter his defence.

Sessions Court judge Azreena Aziz made the order on Kamil Dulajis, 42, after ruling that the prosecutio­n had establishe­d a prima facie case against the accused.

Kamil was alleged to have induced the teenage boy to perform oral sex on him at some bushes near the railway line in Putatan at 7pm on February 5.

The alleged offence, framed under Section 377E of the Penal Code, is punishable with a jail term of up to 15 years and also liable to whipping, upon conviction.

The prosecutio­n had produced eight witnesses to testify in the trial which commenced on August 1.

Deputy public prosecutor Husna Abdul Halim prosecuted while the accused was not represente­d.

The accused is currently detained in custody, pending disposal of the case.

In the Magistrate's Court, two men were jailed for 18 months yesterday for separate charges of possessing stolen items.

Junaidy Jamil, 40, and Sergius Marcus Darau, 28, pleaded guilty before magistrate Afiq Agoes to each of their charges under Section 411 of the Penal Code.

The indictment carries a jail term of up to five years or a fine, or both, upon conviction.

Junaidy, who earned a living as a maintenanc­e worker for an apartment, was arrested for keeping home audio system and a speaker system belonging to a furniture shop at a rental room at the terminal in Inanam on October 20.

Meanwhile, the unemployed Sergius admitted to having the stolen items, namely two Malaysian identity cards and two bank cards found inside a car at Jalan Politeknik in Manggatal on October 31.

In another Magistrate's Court here, a computer technician was sentenced to six months' jail for committing a similar offence.

Senior assistant registrar Herlina Muse, who sat as a magistrate, imposed the sentence on Lee M Kipau after he admitted to retaining two stolen cellphones belonging to a man at an apartment here on November 10.

The magistrate also ordered the three accused persons, who were unrepresen­ted, to serve their jail terms from the date of their arrests.
