Cook in jail for trespassin­g shop and stealing cigarettes

KOTA KINABALU: A cook, who trespassed on a shop and stole RM3,000 worth of cigarettes, was jailed for four years by the Magistrate's Court here yesterday.

Magistrate Afiq Agoes imposed the sentence on Tommy Sali, 33, after he pleaded guilty to a charge under Section 457 of the Penal Code which is punishable by a jail term of up to 14 years and also liable to a fine upon conviction.

The accused, who was defended by counsel Farazwin Haxdy, was caught breaking into the shop of a mini market at Lintas Square in Luyang on October 31 and stole the items.

In pleading for a lenient sentence, Farazwin submitted that his client felt remorseful with what he had done and requested for his jail term to run from the date of his arrest.

Prosecutin­g officer Inspector Mohd Rasydan Jasni pressed for an appropriat­e sentence for the accused.

In an unrelated case, three men were fined by the same court for separate charges of possessing syabu.

Welkie Marten, 35, and Faizal Wira, 25, were fined RM3,000 each, in default, 10 months' jail for possessing 0.05 gram and 0.01 gram of syabu in Putatan and at Sepanggar on September 6 and 29 respective­ly.

Another accused Mohd Rafi Ariffin, 35, received 12 months' jail for having 0.10 gram of syabu in Kampung Air here on May 25.

All of them pleaded guilty to their charges under Section 12 (3) of the Dangerous Drugs Act 1952 which carries a fine of up to RM100,000 or a maximum jail term of five years, upon conviction.
