Attempted rape of daughter: Accused to know fate Jan 26

KOTA KINABALU: A man charged with attempting to rape his 12-year-old daughter two years ago, will know his fate at the Sessions Court here on January 26 next year.

Sessions Court judge Ainul Shahrin Mohamed set the date to deliver its decision on the 34year-old man after the defence closed its case yesterday with one witness called.

The man was alleged to have committed the offence at a house in Jalan Kobusak Penampang at 12pm on March 20, 2015 and was charged under Section 376 (3)/511 of the Penal Code which carries a jail term of between four and 15 years, and whipping, upon conviction.

At the prosecutio­n stage, deputy public prosecutor Hafizah Zahidah Abdullah called nine witnesses to testify. The accused was defended by counsel Dato’ Sri Rakhbir Singh.

Meanwhile, the same court sentenced 13 men to four months jail for entering the state illegally.

The court sentenced the accused persons, aged between 20 to 42 years old, after they all pleaded guilty as charged under Section 6 (1)(c) of the Immigratio­n Act 1959/63.

The indictment carries a maximum fine of RM10,000 or a jail term of up to five years or both and would also be liable to whipping of not more than six strokes of the cane, upon conviction.

Judge Ainul also ordered eight of the men to be whipped once while the rest were spared because of their age.

All the foreigners are to be referred to the Immigratio­n Department for their biometric data to be recorded before deportatio­n.
