Housewife fined for possessing cannabis, syabu

KOTA KINABALU: A 37-year-old woman was fined a total of RM5,100, in default, 16 months' jail for two counts of possessing cannabis and syabu.

Finsensia Paulin Kolin, who appeared before magistrate Cindy Mc Juce Balitus, admitted to possessing 1.44 grams of cannabis and 0.21 gram of syabu in a house at Kampung Madsiang in Manggatal here on July 14, 2014.

She was fined RM2,800, in default, eight months' jail for possessing syabu.

Framed under Section 12 (2) of the Dangerous Drugs Act 1952, the indictment provides for a maximum fine of RM100,000 or a jail term of up to five years, or both, upon conviction.

She also received another fine of RM2,300, in default eight months' jail for possessing cannabis, framed under Section 6 of the same Act, which carries a fine of up to RM20,000 or a jail term of up to five years, or both, upon conviction.

In mitigation, Finsensia, who was represente­d by counsel Aida Jaafar Mad Ariff, told the court that she was a housewife and was still breastfeed­ing one of her children while Finsensia's husband was just a lorry driver assistant.

Prosecutin­g officer Chief Inspector Lim Swee Beng replied that warrants of arrest were issued to Finsensia several times and thus he requested the court to impose a deterrent sentence against the accused.

Based on the facts of the case, Finsensia was arrested during a raid and the drugs were found in the bedroom of her house.

In a separate case, a police sergeant was charged at the same court with consuming syabu.

Hadizul Ayub, 40, who was first arraigned on December 22, 2017, maintained his plea of not guilty before the magistrate when his case came up for case management, yesterday.

He was alleged to have committed the offence at the Kota Kinabalu police contingent (IPD KK) here at 6.03pm on December 5, 2017.

Hadizul faces a charge under Section 15 (1)(a) of the Dangerous Drugs Act 1952, which provides for a maximum fine of RM5,000 or a jail term of up to two years, upon conviction.

The magistrate fixed February 26 for trial and allowed Hadizul's bail of RM1,500 with two local sureties to be extended.

In Tawau, a 39-year-old local man was sentenced to nine years' jail and 10 strokes of the cane by the Magistrate's Court yesterday for possessing syabu.

Magistrate Ferhanshah Farene meted out the sentence on Jong Song Vui for a charge under Section 39A(2) of the Dangerous Drug Act 1952 which provides for not less than five years' jail and whipping of not less than ten strokes upon conviction.

The accused was detained by police during Ops Tapis on October 27, 2016 at about 6.15pm in front of a house at Taman Milan. A body search found two packets of syabu weighing 34.19 grams kept in front of the accused jeans' right pocket.
