Sisters awarded RM55,000 over glass shards in pizza

GEORGE TOWN: The Magistrate’s court here awarded RM55,000 in damages to two sisters who suffered cuts to their mouths and throats after they ate a pizza from Pizza Hut containing glass shards six years ago.

Magistrate A. Akhiruddin, who delivered his decision Thursday, found the pizza chain liable for negligence and ordered the restaurant to pay the women exemplary and general damages.

“I hereby award the plaintiffs exemplary damages of RM2,500 each and general damages totalling RM50,000 to be shared equally by both,” he said in his judgement.

The sisters, E. Kumaravall­y, 40 and E. Uma Mahesari, 32, had filed a suit against Pizza Hut in 2016 over the incident which happened in 2012.

According to their statement of claim, the sisters had ordered the Island Supreme pizzas at the Pizza Hut outlet in Tesco Jelutong at about 1.15pm on November 25, 2012.

They claimed that when they bite into the first slice of pizza, they felt something hard and sharp cut their mouths.

They spit out the pizza and after inspecting the pizza, they found glass shards in it.

They immediatel­y informed the restaurant workers and the restaurant manager took them to a clinic for treatment.

The sisters’ lawyer, J. Shamsher Singh, said they were initially discussing an out-ofcourt settlement with Pizza Hut but the defendants did not come up with a settlement.

The case went to trial where six witnesses were called, including the sisters, the doctor who treated them and workers in the outlet at that time.

The defendant’s statement of defence merely denied the allegation­s filed by the sisters against them.

However, during trial, defence witnesses confirmed that the incident happened and that the manager had taken the sisters to a doctor for treatment.
