Court strikes out prosecutor’s appeal in Pujut rep’s case
KUCHING: The Court of Appeal here yesterday struck out the prosecutor’s appeal against the Miri High Court decision which quashed all three search warrants issued to the police to search three places belonging to Pujut assemblyman Dr Ting Tiong Choon.
Lawyer Wong King Wei, who represented Dr Ting, said the decision was made unanimously by the three-judge panel led by Datuk Tengku Maimum Tuan Mat.
Two other judges sitting at the bench were Datuk Yaacub Mohd Sam and Datuk Zabariah Mohd Yusof.
Wong said before the case was struck out the prosecutor was told to withdraw the case but left it to the court to decide.
The judges, Wong said, ruled that the appeal was redundant, as the warrants had been executed.
On Sept 13, 2016, three search warrants were obtained by the Miri police from the Magistrate’s Court to conduct a search on the properties following a police report lodged by complainant Datuk Hii King Chiong, regarding Dr Ting’s dual citizenship.
The search was conducted by the authority on the next day.
Following the action, Dr Ting filed an application for revision to seek declaration in the High Court that the search warrants were unlawfully issued and not in accordance with the requisite law permitting the magistrate to make such order.
On Dec 2, the High Court in favour of Dr Ting quashed all the three warrants issued.
The prosecutor subsequently appealed against the High Court decision.
Yesterday, Wong further said there will be no more appeal for the case.
