Security officer ordered to defend charge of killing student at bar

KOTA KINABALU: The High Court here yesterday ordered a part-time security officer of the Siam Thai Bar to enter his defence on a charge of killing a college student two years ago.

Justice Datuk Nurchaya Hj Arshad made the order on Mohd Azmin Lidin, 29, after she ruled that the prosecutio­n had establishe­d a prima facie case against the accused.

Mohd Azmin, who was defended by counsel Dato’ Seri Rakhbir Singh, had allegedly murdered Yaacob Nasran, 18, not far from the bar between 4am to 4.30am on December 15, 2016.

The charge was under Section 302 of the Penal Code which carries the mandatory death sentence, upon conviction.

The court fixed the hearing to resume on February 27 and 28 and the defence will be calling two witnesses, including the accused, who opted to give a sworn statement.

Mohd Azmin is currently detained in custody, pending disposal of his case.

Meanwhile, the Magistrate’s Court here fixed February 27 for the mention of a case of a police personnel charged with threatenin­g his wife.

Magistrate Stephanie Sherron Abbie fixed the date for Jumadi Dahlan, 38, yesterday, pending instructio­n from the deputy public prosecutor.

Jumadi was accused of threatenin­g to hurt Hasiah Abdullah, 36, at the police housing in Taman Nelly, Inanam here at 1.58 pm on September 27, 2017.

The offence is framed under Section 506 of the Penal Code, which provides for a jail term of up to two years or a fine, or both, upon conviction.

Earlier, the wife who was also present at court, had withdrawn the report lodged against Jumadi.

She informed the court that she wanted to withdraw the report due to her husband’s career as he will be placed in Gua Musang, Kelantan afterwards.

Prosecutin­g officer Inspector Albert Basirin offered a bail of RM3,000 to the accused.

Jumadi, who was not represente­d, asked for a lower bail amount on the grounds that he will be leaving for Kelantan soon which will include more cost.

The magistrate allowed the accused to be released on RM3,000 bail with two local sureties, pending disposal of the case.
