Man fined RM8,000 for reckless driving, causing fatal accident

KOTA KINABALU: A man was fined RM8,000, in default, six months’ jail by the Traffic Court here yesterday for reckless driving and causing a fatal accident.

Devis James, 20, who appeared before magistrate Cindy Mc Juce Balitus, pleaded as charged under Section 43 (1) of the Road Transport Act 1987.

The indictment carries a fine of up to RM10,000 or a maximum jail term of 12 months, upon conviction.

The accused admitted to the offence committed at Jalan Penampang-Kota Kinabalu on September 3, 2017.

Prosecutin­g officer, Inspector Hanif Mamyudi, told the court that the accused after losing control of his car had hit a tree killing one of the passengers who was trapped in the front seat of the car.

In mitigation, the accused pleaded that this was his first offence and that he had already paid ‘sogit’ (native compensati­on) to the deceased’s heir.

At the same court, Rosa James Jivion, has claimed trial to a charge of driving in a dangerous manner which had resulted in the death of a Pakistani motorcycli­st.

The alleged offence took place at road entrance to Kampung Ramayah in Penampang at 7.45 pm on August 13, 2012.

In view of the plea, the court set April 4 for case management and released the 32-year-old accused on bail of RM3,000 with RM2,000 deposited in two local sureties.

The court also ordered for the accused’s driving license be suspended, pending disposal of her case.
