Sales executive jailed, fined for CBT

KUALA LUMPUR: A sales executive of a goldsmith shop was sentenced to three years' jail and fined RM10,000, in default sixmonths jail by the Sessions Court here yesterday for criminal breach of trust involving RM70,000 worth of jewelry.

Judge Datuk Zainal Abidin Kamarudin handed down the sentence on Choong Pow Yook, 33, after she pleaded guilty to the charge.

Choong a supervisor at Wah Chan Consolidat­ed Sdn Bhd committed the offence by fraudulent­ly misappropr­iating five gold necklaces and four bracelets belonging to the company.

The offence was committed at the Wah Chan Berjaya Times Square branch in Jalan Imbi, here, between 10am and 10pm on May 5, 2017 under Section 408 of the Penal Code which provides for imprisonme­nt of not less than one year and not more than 14 years and liable to whipping and fine upon conviction.

The court ordered the single mother to serve the jail sentence starting from the date of arrest on May 16, 2018.

Earlier, Choong, who was unrepresen­ted appealed for lighter sentence on the grounds that this was her first offence and she was pressed for money to support her nine-year-old child.

However deputy public prosecutor, S. Malini Anne urged the court to impose an appropriat­e sentence considerin­g the seriousnes­s of offence and losses incurred by the employer.

According to the facts of the case, the goldsmith shop manager who was the complainan­t in the case, lodged a police report after discoverin­g that Choong had taken the gold items and sold them to customers outside the shop.
