KOTA KINABALU: A man who tried to stab and assault his elderly father after failing to get his monthly aid given by the Welfare Department, will know his fate on June 20.

Magistrate Cindy Mc Juce Balitus deferred the sentencing of Ghulam Hassan Alih, 27, after the prosecution informed the court that a medical report on the father was not ready.

On the first count, the accused was alleged to have attempted to stab his 74-year-old father with a knife at Kampung Lok Urai in Pulau Gaya at 11pm on May 7.

The alleged offence, under Section 324 of the Penal Code, read together with Section 511 of the same Code, carries a jail term of up to five years or with a fine or whipping, upon conviction.

On the second count, Ghulam was alleged to have assaulted his father at the same time and place.

The alleged offence, under Section 323 of the Penal Code, is punishable with a jail term of up to one year or a fine, or both, upon conviction.

Prosecuting officer Inspector Albert Basiri told the court that on the day of the incident, the accused had demanded cash from his father, who receives a RM300 monthly assistance from the government.

The accused, when he did not get the money, became angry and assaulted his father using a 65 cm piece of wood, causing him to sustain a swelling on his right cheek and reddish bruise mark at the back of his ear.

The accused, who had a sharp weapon, also attempted to stab his father, but was prevented by his siblings staying next door.

Fearing for his safety, the victim lodged a police report, claiming that this was not the first of such incident.

Ghulam, who was denied bail, was ordered to be further held in custody, pending disposal of the case.

It was learnt that the accused had tried to run away after the court hearing, but was arrested by the authorities near the court’s cafeteria.
