Man faces syabu charge

KOTA KINABALU: A jobless man claimed trial at the Sessions Court here yesterday to possessing 37.79 grams of syabu.

Tadih Hassan, 26, who was brought before judge Azreena Aziz, faced a charge under Section 12 (2) of the Dangerous Drugs Act 1952 and punishable under Section 39A (2) of the same Act.

He is liable to life imprisonme­nt or a jail term of not less than five years and whipping of not less than 10 strokes of the cane, if found guilty.

Tadih was alleged to have in his possession the said drugs beside a restaurant in Bandar Sierra here at 6.30pm on October 31, 2017.

Earlier, deputy public prosecutor Husna Abdul Halim told the court that the accused was a non-Malaysian without any documents.

She also said that the offence was non-bailable and thus, she offered no bail to the accused, who was not represente­d.

Husna also informed the court that the prosecutio­n was expected to call four witnesses to testify against the accused.

The court fixed August 17 for trial and ordered the accused to be further detained in custody, pending disposal of the case.

In another case, the same court sentenced a man to 15 years’ jail plus 10 strokes of the cane for possessing 32.58 grams of syabu.

The judge imposed the sentence on Muhammad Ali Kimura after he was found guilty of committing the offence, charged under Section 12 (2) of the Dangerous Drugs Act and punishable under Section 39A of the same Act.

He was found in possession of the drugs at a house in Kampung Boronoun, Telipok, Tuaran on March 28, 2017.

The court also ordered Muhammad Ali to serve the jail term from his date of arrest and to be referred to the Immigratio­n Department for his biometric data to be recorded before deportatio­n.

In mitigation, Muhammad Ali asked for lenient sentence as he had a family to support while Husna requested for a deterrent sentence to be imposed against Muhammad Ali as the offence committed was a serious one.
