Company fined over unregister­ed health products, cosmetics

KOTA KINABALU: A health and beauty company was fined a total of RM4,000 for possessing unregister­ed health products and a cosmetic without notificati­on.

Sessions Court judge Ainul Shahrin Mohamed imposed the fine on the human resource manager of the company, Rohaya Shaepiin, after the latter pleaded guilty to both charges under the Control of Drugs and Cosmetic Regulation­s 1984.

On the first charge, the company was fined RM2,000 fine for having five types of various health products such as Queen of Mutiara, Herbal Detox D'herbs health Sdn Bhd, Rerama Plus, Belalai Gajah Plus Durian Belanda and Gel Amani.

The said products were not registered with the Ministry of Health.

The offence was framed under Rule 7(1)(a) of the Control of Drugs and Cosmetics Regulation­s 1984 and punishable under Section 12(1) of Sale of Drugs Act 1952 which carries a maximum fine of RM25,000 or a jail term of up to three years, upon conviction.

For the second charge, the company was further fined RM2,000 for possessing a cosmetic product, Dnars Sunny Cream, which has no notificati­on.

The offence was under Rule 18A (1)(a) of the Control of Drugs and Cosmetics Regulation­s 1984 and punishable under Section 12(1) of Sale of Drugs Act 1952.

The offence took place at its premises in Wisma Ong Ee, Kota Marudu at 11.55am on January 17.

Ainul also ordered all the products to be passed to the prosecutio­n for disposal.

In mitigation, Rohaya who was not represente­d, told the court that some of the products were advertised in television commercial­s, thus she did not know that the products were unregister­ed and had no notificati­on. Therefore, she prayed for leniency and to pay in installmen­ts. Meanwhile, prosecutin­g officer from the Pharmacy Department urged for a deterrent sentence for the sake of public safety as the products are of questionab­le quality.
