Company fined over unregistered health products, cosmetics
KOTA KINABALU: A health and beauty company was fined a total of RM4,000 for possessing unregistered health products and a cosmetic without notification.
Sessions Court judge Ainul Shahrin Mohamed imposed the fine on the human resource manager of the company, Rohaya Shaepiin, after the latter pleaded guilty to both charges under the Control of Drugs and Cosmetic Regulations 1984.
On the first charge, the company was fined RM2,000 fine for having five types of various health products such as Queen of Mutiara, Herbal Detox D'herbs health Sdn Bhd, Rerama Plus, Belalai Gajah Plus Durian Belanda and Gel Amani.
The said products were not registered with the Ministry of Health.
The offence was framed under Rule 7(1)(a) of the Control of Drugs and Cosmetics Regulations 1984 and punishable under Section 12(1) of Sale of Drugs Act 1952 which carries a maximum fine of RM25,000 or a jail term of up to three years, upon conviction.
For the second charge, the company was further fined RM2,000 for possessing a cosmetic product, Dnars Sunny Cream, which has no notification.
The offence was under Rule 18A (1)(a) of the Control of Drugs and Cosmetics Regulations 1984 and punishable under Section 12(1) of Sale of Drugs Act 1952.
The offence took place at its premises in Wisma Ong Ee, Kota Marudu at 11.55am on January 17.
Ainul also ordered all the products to be passed to the prosecution for disposal.
In mitigation, Rohaya who was not represented, told the court that some of the products were advertised in television commercials, thus she did not know that the products were unregistered and had no notification. Therefore, she prayed for leniency and to pay in installments. Meanwhile, prosecuting officer from the Pharmacy Department urged for a deterrent sentence for the sake of public safety as the products are of questionable quality.
