Man jailed for breaking glass window of shop

KOTA KINABALU: A 22year-old man was jailed for 18 months by the Magistrate’s Court here yesterday for breaking a glass window of a convenienc­e shop using a brick.

Magistrate Cindy Mc Juce imposed the sentence on Alpa Tam, after he admitted to committing mischief at the shop in Manggatal here at 4.10am on June 23.

The alleged offence was framed under Section 427 of the Penal Code, which provides for a jail term of not less than a year and not more than five years or a fine or to both, upon conviction.

In mitigation, the accused, who was not represente­d, told the court that he was a firsttime offender and promised not to repeat a similar offence while prosecutin­g officer Inspector Suzie @ Stephanie Kupit requested for a deterrent sentence to be imposed against Alpa.

The court ordered him to serve the sentence from the date of arrest and to be referred to the Immigratio­n Department after serving the sentence.

In facts of the case stated that the accused was seen throwing the brick at the glass window by an employee of the shop.

The accused was caught thereafter sent to the police station for further action.

Meanwhile, in another case, a man was sentenced to a day’s jail for unruly behaviour against another man, asking for a loan payment.

Sim Ee Heng, 31, who pleaded guilty before the magistrate, had committed an offence under Section 8 (1)(e) of the Minor Offences Ordinance.

He committed the offence at a condominiu­m in Jalan Istiadat Likas here at 1pm on July 2.
