Father withdraws police report against son

KOTA KINABALU: The Magistrate’s Court here fixed today to re-mention the case of a son, who allegedly tried to stab his elderly father after failing to get his father’s monthly aid given by the Welfare Department, to produce a police report on the withdrawal of the earlier report against the son.

Magistrate Cindy Mc Juce Balitus will again hear the case of Ghulam Hassan Alih, 27, after the victim, who was present in court yesterday, said that he decided not to proceed with the police report against his son.

The victim explained that the decision was made as he is an old man, who did not have so much energy to go the police station whenever he is needed for the case.

However, when asked by the court regarding a police report on the withdrawal, the victim said from the witness dock that he have not lodged any police report on the withdrawal.

The accused, who was supposed to stand trial yesterday, was alleged to have attempted to stab the 74-year-old victim using a knife at Kampung Lok Urai in Pulau Gaya at 11pm on May 7.

The alleged offence was under Section 324 of the Penal Code, read together with Section 511 of the same Code, which carries a jail term of up to five years or with a fine or whipping, upon conviction.

The unrepresen­ted accused had previously been sentenced to 12 months’ jail for injuring his father at the same time and place.

The charge was under Section 323 of the Penal Code which is punishable by a jail term of up to one year or a fine or both, upon conviction.

Prosecutin­g officer Inspector Albert Basiri appeared for the prosecutio­n.
