Four days' jail for threat to kill brother

KOTA KINABALU: A man was sentenced to four days’ jail by the Magistrate’s Court here yesterday for causing fear to his brother by threatenin­g to kill him over the right to stay at their mother’s house.

Magistrate Stephanie Sherron Abbie imposed the sentence on Fikol D. Iomodi, 50, after he pleaded guilty to uttering the harsh words to his sibling at a house in a village in Penampang on September 15.

The unrepresen­ted accused was convicted under Section 8 of Minor Offences Ordinance which carries a fine of up to RM25 or a maximum jail of one week, upon conviction.

Prosecutin­g officer Inspector Albert Basiri told the court that the complainan­t had lodged a police report against the accused stating that while the complainan­t was at their mother’s house, the accused came and said: “Saya kasi mati kamu semua di sana, tiada hak kamu tinggal sana, itu rumah saya” (I will kill all of you here, all of you have no rights to stay here, this is my house).

Investigat­ion revealed that the complainan­t and his family stayed at the house and a family misunderst­anding had happened.

The complainan­t had asked for some time from their mother before he and his family moved out of the house.

Then on the day of the incident, when the complainan­t was packing their things as they would be moving out of the house, the accused came to make a public nuisance there and made a verbal threat which caused the complainan­t to feel afraid for his family’s safety.

In a separate case, a man was jailed for one week by the same court for committing a similar offence.

Chin Yian Heng, 36, admitted to threatenin­g another man if he failed to pay his debts at a premises in Penampang on March 10.

The facts of the case stated that on April 2, the complainan­t went to lodge a police report saying that the accused came to the premises with four of his friends demanding the complainan­t must pay his debt of RM200,000.

But since the complainan­t was unable to provide the amount the accused threatened him by saying that his boss would send people to hit the complainan­t if he did not want to pay his debt.

The court ordered both the unrepresen­ted accused to serve their jail terms with effect from yesterday.
