Man jailed 40 months for housebreak­ing, trespassin­g

KOTA KINABALU: A 30-yearold man was sentenced to a total of 40 months' jail for two counts of breaking into a house and trespassin­g.

Magistrate Stephanie Sherron Abbie imposed the sentence on Alester Josh Marail yesterday after he admitted to committing the offences.

On the first count, he was jailed 24 months for breaking into a house belonging to one Ferra Phoebe Jinius Totu, 20, in order to commit theft at Kampung Boliga in Penampang at 5.30 pm on August 1.

The offence is framed under Section 457 of the Penal Code which carries a jail term of up to 14 years and is also liable to a fine, upon conviction.

Based on the facts, the property is a double-storey house and the complainan­t of the case lost RM6,000 cash which she put in a drawer inside her wardrobe.

The accused received another 16 months' jail for house-trespassin­g at a house belonging to one Jon Warren Norman, 25, in Kampung Pogunon, Penampang at 7.45 am on September 6.

The offence was framed under Section 448 of the Penal Code, which provides for a jail term of up to three years or a maximum fine of RM5,000 or both, upon conviction.

The facts of the case stated that the accused was caught wandering at the house by the complainan­t.

Also found in the accused's hand were a screwdrive­r, a modified iron rod and a walkie talkie which were suspected to be tools used for house-breaking.

The court also ordered the accused to serve the jail sentences consecutiv­ely.

Apart from that, Alester has also been charged with consuming syabu, however, no plea was taken, pending his chemistry report.
