Man jailed for possessing, disposing of stolen motorcycle­s

KOTA KINABALU: Disposing of a stolen motorcycle landed a man in jail for 15 months.

Mohd Fazli Badrun, 36, received the sentence after pleading guilty yesterday before Sessions Court judge Ainul Shahrin Mohamed, to committing the offence.

He had disposed the stolen C100B motocycle at Kampung Sungai Damit in Bongawan, Papar at 3 pm on August 28.

The offence was framed under Section 414 of the Penal Code, which provides for a jail term of up to seven years or a fine, or both, upon conviction.

He was also ordered to pay RM2,000 compensati­on to the victim, in default, 12 months' jail while the custodial sentence is to be served from the date of arrest.

Deputy public prosecutor Rustam Sanip prosecuted.

In another courtroom, Mohd Fazli was jailed another 14 months for having another stolen motorcycle at a parking area in Melinsung Apartment, Papar.

Magistrate Stephanie Sherron Abbie imposed the sentence on Mohd Fazli after he admitted to the charge under Section 411 of the Penal Code, which provides for a jail term of up to five years and also liable to a fine or both, upon conviction.

Mohd Fazli had possessed the stolen Demak Spark motorcycle which belongs to one Rif'All'Alim Hamid, 27, at the said place on September 7, 2017.

According to the facts of the case, the motorcycle which was parked at a barracks in Lok Kawi Army Camp, was reported missing by the complainan­t on September 2.

Acting on a tip off, police managed to arrest Mohd Fazli together with the motorcycle at Melinsung Apartment on September 6.
