Brothers want suit against Najib combined with bank's suit

KUALA LUMPUR: The High Court has set Nov 30 to hear the applicatio­n by businessma­n J.R. Deepak Jaikishan and his brother to consolidat­e their lawsuit against Datuk Seri Najib Tun Razak and four others for alleged conspiracy and Bank Rakyat's lawsuit against them.

Lawyer Mohamed Haniff Khatri Abdulla, who is representi­ng Deepak Jaikishan, 46, and the director of Radiant Splendour Sdn Bhd, Rajesh Jaikishan, 45, told reporters this after case management in Judge S. Nantha Balan's Chambers, yesterday.

He said, in the suit filed by Bank Rakyat against Deepak Jaikishan and Rajesh, the bank had named the two brothers and their company Radiant Splendor Sdn Bhd as defendants.

Mohamed Haniff Khatri also said Najib and his wife, Datin Seri Rosmah Mansor, had appointed lawyer David Matthews to represent them in the suit.

On Sept 12, Radiant Splendour Sdn Bhd, Deepak Jaikishan and Rajesh as the first to the third plaintiffs filed the suit through Messrs Haniff Khatri Abdulla and named Najib, Rosmah, lawyer Datuk Ahmad Johari Abdul Razak, Tabung Haji chairman Datuk Seri Abdul Azeez Abdul Rahim and Bank Kerjasama Rakyat Malaysia Berhad chairman Tan Sri Shukry Mohd Salleh as the first to the fifth defendants.

In the statement of claim, the plaintiffs claimed that Najib was acting out of bounds and abusing his power by instructin­g Bank Kerjasama Rakyat Berhad to file various legal suits against them, especially on the second plaintiff Deepak.

Deepak claimed it was to prevent him from giving oral testimony honestly during a civil case hearing over Altantuya Shaariibuu's murder involving Najib, Rosmah and Ahmad Johari.

The plaintiff also claimed that there was an agreement dated July 24, 2008 with Bank Kerjasama Rakyat Berhad under the direction of Shukry (then chairman of Bank Kerjasama Rakyat), who agreed to give and provide financing facilities up to RM198,888,750 and in return they had to give up the absolute rights and vested interest to 80 apartment units under developmen­t, namely Condominiu­m Palazzio Tower B.
