AGC still considering representations against single mother’s acquittal

-

KUALA LUMPUR: The AttorneyGeneral’s Chambers (AGC) is still reviewing letters of representation filed by several parties to review the AGC’s decision to drop a charge against a single mother for allegedly making a false report on a man over a molest case involving a four-year-old girl.

A source from the AGC said that the Chambers had received several letters of representation among others from Malaysia Hindu Sangam (MHS), the lawyers representing the complainant and former employer of the complainant.

“We (the AGC) will look into the representations and we will decide later after considering all aspects whether it is possible to review our decision to drop the charge against the accused (the woman),” the source told Bernama when contacted yesterday.

On April 16, Maya Ahmad Fuaad (rpt Fuaad) 36, pleaded not guilty at the Shah Alam Magistrate’s Court to allegedly lodging a false report to Corporal Hazarul Shahkifly Setia, with the intention of calling upon the police to take action against K.Mathurai Veeran, the driver of Maya’s former father in law.

Mathurai Veeran was the complainant in the case.

She (Maya) was accused of committing the offence at the Kota Damansara Police Station, on June 30, last year.

However, last month, on Oct 1, the AGC had dropped the charge against her before the commencement of trial.

Meanwhile, MHS in its press release yesterday revealed it had sent a letter of representation on behalf of the aggrieved party Mathurai Veeran to the AGC to investigate allegations that certain “invisible hands” linked to the former ruling Government had pressured the AGC to drop a charge against his victimiser after there was an attempt to “pay off” Mathurai Veeran to withdraw this complaint.

“We the Malaysia Hindu Sangam stand in solidarity with Mathurai Veeran and his family to urge the Attorney-General to investigate the role that the “invisible hands” had played in pressuring the AGC to drop the charge against Maya on 1 October 2018 even before the trial had started”, said Datuk Mohan Shan, president of MHS.

He said they were also deeply shocked and disturbed that not long after their first press conference on Oct 18 this year to highlight the AGC’s sudden dropping of the charge, there was a brazen attempt made by an individual to offer Mathurai Veeran a certain sum of money so that he would withdraw his complaint where the timing of the offer was very suspicious.

“The AGC drops the charge against the accused and few days later the victim gets an offer to be silenced. That is very suspicious indeed. Mathurai Veeran has since filed a police report and a report with the Malaysian AntiCorruption Commission (MACC).

“We implore the AttorneyGeneral to thoroughly review the entire evidence in this case including calling up those who investigated the complaint as we believe the evidence that led to the charge in the first place is overwhelming. Mathurai Veeran is not interested in a bribe,” the statement said.

According to the statement, Mathurai Veeran was vindicated when the allegations of child sexual offence (molest) against him were classified as No Further Action (NFA) and Maya instead was charged on of April 16 2018 under Section 182 of the Penal Code for allegedly making a false report.

The statement said because of the allegation and high handed approach of individuals linked to the former ruling Government, Mathurai Veeran subsequently lost his long term employment.
