KOTA KINABALU: A businessman from Ipoh, who is charged with annoying his exgirlfriend through Facebook, will stand trial at the Sessions Court here on April 3-5 next year.

Judge Ainul Shahrin Mohamed set the date for Seevashankar Vickneswaran A/L Tamalsilvan, 26, yesterday when the case came up for pre-trial case management.

The court was informed that the representation letter made by Seevashankar’s counsel was rejected by the prosecution headquarters and therefore the trial was fixed on the said date.

Seevashankar was alleged to have improperly used a network service by initiating the transmission of an unkind comment and pictures to annoy the victim, who is a pharmacist in Sabah.

He was alleged to have committed the offence on social media Facebook along Jalan Bandar Baru Tambun, Bandar Baru Tambun in Ipoh, Perak at 11.50am on August 16, 2017.

The offence is framed under Section 233 (1) (a) of the Multimedia Communication Act 1998 (Act 588) which is punishable under Section 233 (3) of the same Act.

The indictment carries a fine of up to RM50,000 or one year’s jail, or both, and shall also be liable to a further fine of RM1,000 for every day during which the offence is continued after conviction.

The accused was represented by counsel Farazwin Haxdy and currently released on RM5,000 bail in a local surety, pending disposal of the case.
