Pakistani trader jailed, caned for cheating

KOTA KINABALU: A Pakistani trader was sentenced to two years jail and ordered to be given two strokes of the cane for cheating on the purchase of rice and cigarettes.

Magistrate Stephanie Sherron Abbie imposed the sentence on Wakil Khan Waris Khan, 36, after he pleaded guilty as charged under Section 420 of the Penal Code, read together with Section 34 of the same Code.

The indictment carries a jail term of up to 10 years and whipping and also liable to a fine, upon conviction.

On the first count, the accused was sentenced to one year's jail and one stroke of the cane for deceiving a representa­tive of a company by inducing him to hand over 3,000 bags of rice which he paid with two cheques worth RM70,990 under Mardinah Store Sdn Bhd whose account had been closed.

Wakil committed the offence with an accomplice at a company in Inanam and a shop at Bandaran Berjaya here on April 18, 2017.

The accused received the same punishment for his second offence of cheating another representa­tive of a company by inducing him to hand over 880 boxes of cigarettes worth RM13,914.31. The offence, committed with a friend who is still at large, took place at a company here on January 3.

The court ordered the accused to serve his jail terms concurrent­ly from the date of his arrest on February 2, and to be referred to the Immigratio­n Department after serving his jail sentences for further action.

Inspector Mohd Rasydan Jasni prosecuted while counsels Aaron Mah and Kimberly Ye of the National Legal Aid Foundation represente­d the accused.
