March 15 ruling on brothers accused of raping sister

KOTA KINABALU: Two brothers will know whether they have a case to answer at the Sessions Court here on March 15 over a charge of raping their teenage sister in Papar.

Judge Noor Hafizah Mohd Salim fixed the date for the duo, aged 26 and 25, after the prosecutio­n closed its case following testimonie­s by five witnesses.

The brothers were accused of raping the girl, aged 17 years and seven months at an unnumbered house at a village in Papar at 2am on June 6, 2018.

They were charged under Section 375B of the Penal Code, which provides for a jail term of not less than 10 years and not more than 30 years, upon conviction.

Counsel Farazwin Haxdy represente­d both accused, who are currently detained in custody, pending disposal of the case.

Meanwhile, another Sessions Court yesterday set March 27 to rule on the case of a local contractor who was charged with deceiving the Accountant-General’s Department by submitting false claim documents.

Judge Abu Bakar Manat fixed the date after the prosecutio­n had called 25 witnesses to testify against Kaslan Jiman, 47.

Kaslan allegedly committed the offence on October 28, 2013 at the Sabah branch of the Malaysia Accountant-General’s Department here by submitting an undated invoice No. RW0413 in the name of Nisha Enterprise and government order P13000085 dated October 22, 2013 to assistant accountant Juslin Lingok from the payment unit of the department.

The documents were allegedly for repair works to the doors of the administra­tive office, library and student affairs office of the National Youth Skills Training Institute in Kinarut, worth RM19,800, which were not carried out.

Kaslan is charged under Section 18 of the Malaysian AntiCorrup­tion Commission (MACC) Act 2009 which carries a jail term of up to 20 years and a fine of up to five times the amount involved or RM10,000, whichever is higher, upon conviction.

He is currently released on bail of RM20,000 with RM10,000 deposited in one surety and was represente­d by counsel Hamid Ismail.
