Trial of woman charged with using fake company’s report deferred
KOTA KINABALU: The Magistrate’s Court here deferred the trial of a woman charged with using as genuine a fake company’s annual report to April 29-30.
Magistrate Mohamad Aizat Abdul Rahim put off the case of Wong Nyuk Fung, 54, after counsel Ram Singh, who represented the accused, requested the postponement when the case came up for trial yesterday.
Ram explained that the complainant lodged his complaint with the Sabah Adevocates Disciplinary Board against him, and contended that Ram could not represent the accused in the case.
Ram argued that the accused has a right to choose her counsel to defend her and he told the court that he was challenging the complaint with the board, which was set for review in April.
Deputy public prosecutor Siti Amirah Muhammad Ali raised no objection to Ram representing Wong as it was the accused’s right to choose Ram as her counsel.
The magistrate said that the complaint was only set for review and Ram can still practice because there is still no official order from the board.
Wong was alleged to have used the forged document at Lintas Square in Luyang between 9am and 5pm on August 14, 2014.
The charge was framed under Section 471, punishable under Section 465 of the Penal Code, which is punishable by a jail term of up to two years or a fine or both, upon conviction.
The accused is currently released on RM3,000 bail with RM2,000 deposited with two local sureties.
