Court to rule on rape case March 29

KOTA KINABALU: A 49-yearold man will know his fate on March 29 this year on two counts of raping a teenager in ‘rumah kongsi’, Penampang.

Sessions Court judge Azreena Aziz fixed the ruling date on Danny Aisal after the defence closed its case with one defence witness called.

On the first count, he was alleged to have raped the 15year-old girl at the ‘rumah kongsi’ in Kampung Ketiau, Penampang at 10pm on April 15, 2017.

On the second count, he is accused of committing the same offence against the same girl at the same place at 11pm on April 16, 2017.

At the time of the alleged offence, Danny had allegedly put the girl in fear of death.

For the alleged offences framed under Section 376 (2)(b) of the Penal Code, he faces imprisonme­nt terms of not less than 10 years and not more than 30 years and shall also be punished with whipping, upon conviction.

Danny pleaded not guilty to the charges on March 7, 2018 and he was ordered to enter his defence after the court ruled that the prosecutio­n had establishe­d a prima facie against him on January 28.

Throughout the trial, the prosecutio­n had produced nine witnesses while Danny was the sole defence witness.

Danny is currently further detained in custody, pending disposal of the case.
