Prisoner gets 13 years for sodomising ex-cellmate

KOTA KINABALU: A 22-yearold prisoner was sentenced to 13 years in jail plus one stroke of the cane for committing sodomy against his former cellmate.

Sessions Court judge Noor Hafizah Mohd Salim imposed the sentence on Mohd Fazil Juwandah when the case came up for social report and sentencing, yesterday.

Mohd Fazil had committed carnal intercourse against the order of nature on a 21-year-old man at the central prison here at 1am on December 6, 2017.

The offence is framed under Section 377C of the Penal Code, which carries a maximum jail term of 20 years and also liable to whipping, upon conviction.

In the social report, which was submitted by a Welfare officer, Mohd Fazil, who received education until Form Two of secondary school, also went to a reform school for three years.

Thus, the officer recommended that Mohd Fazil be sentenced to imprisonment.

Meanwhile, the unrepresented Mohd Fazil, in his mitigation, prayed for leniency and promised not to repeat a similar offence.

He said he wanted to take care of his mother once he served his sentence and released from prison.

Deputy public prosecutor Mohamad Ali, however, urged the court to impose a deterrent sentence against the accused to serve as a lesson to the accused and a warning to the public at large.

He submitted that the accused had committed the offence two months after he was jailed for committing a similar offence, which showed that the accused is not remorseful of his act.
